The following General Terms and Conditions of Berlitz Sprachcenter Dr. K. & G. Eiba Sprachenschule OHG – hereinafter referred to as Berlitz Augsburg – form the basis for all contractual agreements concerning the services/products offered on the website www.berlitz-augsburg.de, particularly language instruction. Exceptions are Berlitz seminars and Kids language camps which, as stated on the website, are exclusively provided by Berlitz Augsburg and are entirely subject to their terms and conditions.
The website of Berlitz Augsburg is aimed at both businesses and private and commercial users (hereinafter referred to as “users”). These terms and conditions apply to both parties.
The individual provisions of our terms and conditions apply respectively to consumers and businesses under §310 BGB. Provisions that are explicitly described as applicable to businesses do not apply to consumers. Consumers in the sense of these terms are natural persons who enter into a business relationship with Berlitz Augsburg without a commercial or freelance professional purpose. User terms and conditions only apply if Berlitz Augsburg has expressly agreed to them in writing. Note that specific services/products may be subject to separate T&Cs or registration requirements, which will be stated in the context of those offerings.
The user registers/orders the relevant service/product by completing and submitting the “Course Registration” form. This constitutes a binding offer to purchase the selected service/product from Berlitz Augsburg. Berlitz Augsburg accepts this offer by sending a confirmation email. The contract comes into effect when the user receives the confirmation email.
Scheduling commitments made by Berlitz Augsburg are subject to the availability of instructors. Berlitz Augsburg strives to provide a replacement instructor if needed. There is no entitlement to be taught by a specific instructor. Lessons or programs canceled by Berlitz Augsburg will be rescheduled. If rescheduling is not possible, Berlitz Augsburg agrees to refund any unused fees at the end of the program. A change of instructor is part of the Berlitz Method and does not entitle the customer to cancel or withdraw from the contract. Berlitz Augsburg is not liable for the achievement of a specific learning outcome. The number of units (UE) suggested to reach a learning goal is based on years of experience and may vary in individual cases.
Users may withdraw from the contract in writing (e.g., by letter, fax, or email) within two weeks without stating reasons. The deadline begins on the day the contract is concluded. It is sufficient to send the cancellation notice before the deadline expires. If the course has already started or the first lesson has been completed, the right of withdrawal no longer applies.

For the delivery of products or teaching materials, the withdrawal period starts on the day of receipt by the user. Regardless of the right of withdrawal, already-used services must be paid for.
The prices applicable are those at the time of order. The prices listed on www.berlitz-augsburg.de include VAT unless otherwise stated. Some services/products may be exempt from VAT. Prices for instruction and materials are based on the user’s placement into a specific course. If placement differs from the actual needs, prices may be adjusted accordingly.
Prices are determined by the respective service/product description at www.berlitz-augsburg.de. The user agrees to pay the listed price. Payment is due upon registration/order.
One lesson unit (UE) consists of 40 minutes. A 5-minute break follows each unit. The customer agrees that a Berlitz academic supervisor may attend lessons for quality assurance purposes.
Customers must pay course fees no later than the start of the first lesson. If paying in installments, the first payment is due before the first lesson, with remaining payments charged every 4 weeks. All materials must be paid for immediately upon receipt. The signed agreement also serves as an invoice; separate invoices are only issued upon request. Payments are applied to the oldest outstanding balance unless otherwise specified. If no lessons are taken for more than six months, Berlitz Augsburg may adjust the price in case of a tariff change. Customers will be informed accordingly.
The schedule is determined between the customer and Berlitz Augsburg’s front desk, not the instructors. If a customer cannot attend a lesson, they must inform Berlitz by 2:00 p.m. the previous business day. For Monday lessons, cancellation must be made by 2:00 p.m. the previous Friday. Failure to cancel on time results in charges. Paid but unused lessons may be transferred to a third party if Berlitz is informed in writing. The contract can be canceled with 5 business days’ notice. The customer is entitled to a refund of unused but paid-for lessons after the cancellation period.
The “Berlitz One-on-One Happy Hour” program is valid for new individual or small group (max. 2 participants) bookings only. It cannot be converted from an existing contract. Lessons must take place Monday–Friday from 12:00 to 15:30 or Saturday from 8:00 to 14:00 at the Berlitz Augsburg Center.
This plan includes a minimum of 20 lessons per week, scheduled in advance. All lessons and materials must be paid in full before the first lesson. The contract can be canceled up to 5 business days before the first lesson; later cancellations are not permitted. No refunds will be issued for unused lessons in the event of late cancellation.
Start dates are listed on www.berlitz-augsburg.de. Berlitz Augsburg reserves the right to reassign participants to a different group for pedagogical reasons to ensure optimal learning. Cancellation is free up to 4 weeks before the start of the course. Later cancellations are subject to a 20% fee for group courses and 50% for crash courses (20+ lessons/week). For crash courses canceled less than 5 days before the start, 70% of the course fee is charged.
If a course has already started, customers who miss lessons (due to illness, vacation, etc.) are still required to pay. The contract may be canceled with 4 weeks’ notice to the end of a calendar month, but not earlier than 3 months after the course start. Termination without notice is only permitted for serious reasons. If the customer defaults on payment, Berlitz Augsburg may also terminate the contract without notice. Termination must be made in writing. If a student continues to attend lessons after the agreed period, the contract is considered renewed under the current terms.
For Berlitz Kids programs: If a child disrupts the course in a way that affects the learning of others, the child may be excluded. Unused but paid lessons will be refunded.
Each course has a minimum number of participants. If this is not reached, the number of lessons is reduced accordingly (with the price unchanged). UE counts are per Berlitz level.

Berlitz Augsburg is entitled to dissolve a group or reduce the number of hours in group instruction if the minimum participant number is not met. In the case of group dissolution, Berlitz Augsburg is obligated to refund course fees for unused UE.
Unused but already paid UE expire 12 months after the last used lesson. Separate written agreements are possible. Refunds for UE after the 3-year statutory period are excluded. No refunds will be given for paid and handed-out materials or enrollment fees.
Registrations are processed and confirmed in the order they are received. Verbal reservations are not possible. Upon registration and payment via direct debit authorization, a deposit of €165 is due. The remaining balance is due 6 weeks before the start of the camp. For payment by credit card, the full amount of the booked camp is due at the time of booking.
By registering, the legal guardians also agree to pay the full travel costs before the camp begins. If Berlitz has not received proof of payment for travel costs by the start of the camp, the child will not be allowed to participate. Berlitz retains the right to claim reimbursement of the travel costs.
Reference is made to the right of withdrawal described in Section 3 of these Terms & Conditions. In addition, a cancellation right up to 4 weeks before the start of the camp is granted. Cancellation must be submitted in writing by the legal guardians to Berlitz Kids & Teens, Günther Bedson, Kurfürstendamm 203, 10719 Berlin, by fax to 030/88472476, or by email. The date of receipt by Berlitz is decisive for validity. In the case of a valid cancellation, the €165 deposit will be retained. Any additional payments made will be refunded. If the cancellation occurs less than 4 weeks before the camp starts, no refund will be issued.
No refunds will be given for services not used or payments made if a child interrupts or ends their stay at the camp. If a child is required to leave the camp due to their own misconduct, refunds are likewise excluded. Children with contagious illnesses cannot continue participating in the camp to prevent the risk of infection to others. If a child requires medical attention during the camp stay, all additional costs (e.g., transportation to doctors or hospitals, or necessary medical care) are to be covered by the legal guardians. These costs must be reimbursed immediately upon presentation of receipts, should Berlitz initially cover them. It is strongly recommended to take out personal travel cancellation and interruption insurance.
In the event of a move to another federal state with conflicting school holiday dates, a free rebooking to another camp is possible upon submission of appropriate documentation and within the availability of free spots. If no spots are available, travel costs will be refunded in this case.
The scope of services provided during the camp is based on the information at www.berlitz.de. If a specific service cannot be offered due to force majeure (e.g., bad weather), Berlitz reserves the right to provide an alternative program in individual cases. Cancellation of the camp due to such changes in service is not permitted.
Berlitz assumes no liability for health-related or other damages to participants or third parties unless such damages are due to the fault of Berlitz supervisory staff. Liability for minor negligence is excluded. It is recommended that customers verify their personal liability and accident insurance coverage (family insurance). Berlitz is not liable for loss, theft, or damage to personal items brought to the camp. Costs for damages to the camp property or items owned by Berlitz that are proven to be caused by a child must be covered by the legal guardians. It is strongly advised not to bring expensive electronic devices, jewelry, or other valuables to the camp.
The number of participants for Berlitz Seminars is limited to 5 for Business English seminars and a maximum of 10 for all other open seminars.
The participation fee – for management seminars plus applicable VAT – is due upon receipt of the invoice, but no later than 14 days before the start of the seminar. This fee includes the execution of the seminar and all seminar materials.
For open seminars, the fees also include snacks and beverages during breaks as well as lunch (not applicable to Business English seminars).

For cancellations up to three weeks (21 days) before the seminar, a processing fee of €150 – plus statutory VAT for management seminars – will be charged. For later cancellations, the full participation fee will be charged. Cancellations must be submitted in writing (by mail, fax, or email). Substitute participants can be named at any time.
Free rebooking to a comparable seminar is only possible up to 3 weeks (21 days) before the seminar date and with Berlitz’s approval. Rebooking is subject to availability in the target seminar. Fees already paid will be transferred to the new seminar. A processing fee of €50 – plus VAT – will be charged for any rebooking within 3 weeks (21 days) before the seminar. Rebooking is not possible from the seminar start date onward.
Customers have no automatic right to rebooking. If rebooking is not possible, the cancellation conditions apply.
Each participant is responsible for their own accommodation and meals. Please refer to Section 4 above.
Berlitz reserves the right to cancel an open seminar – e.g., due to instructor unavailability or insufficient registrations. Berlitz commits to notifying participants of cancellations or necessary program changes as early and promptly as possible before the seminar.
If a seminar is canceled, Berlitz will either refund the seminar fee or issue a transfer voucher upon request. This voucher can be used for a rescheduled seminar or a different one. Any price differences will be adjusted accordingly – either refunded by Berlitz or paid by the participant 14 days before the new seminar date.
Further claims are excluded unless they result from intentional or grossly negligent conduct by Berlitz staff or agents.
In exceptional cases, Berlitz reserves the right to make reasonable changes to the program, date, instructors, or venue. In such cases, participants will be notified immediately.
Berlitz is not liable for loss or damage to personal belongings unless the loss or damage was caused by proven intentional or grossly negligent conduct by Berlitz staff or agents. Participants are advised not to leave valuables or important materials unattended in the seminar room during breaks.
Materials issued by Berlitz Augsburg are protected by copyright and may not be copied or used commercially — even in excerpts — without prior permission from Berlitz Augsburg and the respective instructors.
Berlitz Augsburg reserves the right to discontinue services offered on www.berlitz-augsburg.de without justification. The user acknowledges this right. Berlitz Augsburg is not liable for damages or loss of profit.

Berlitz Augsburg is not liable for the achievement of any specific learning or seminar outcomes. Berlitz Augsburg is also not liable for cancellations due to force majeure.
Mandatory legal liability provisions remain unaffected.
If the user is a merchant or legal entity under public law, the exclusive place of jurisdiction for all disputes is Augsburg. Otherwise, the statutory jurisdiction applies.
Only the law of the Federal Republic of Germany applies.
Amendments and additions to the contract must be in writing.
If any clause is invalid, Berlitz Augsburg may replace it with a valid clause with a similar purpose.
If this is not possible, statutory provisions apply.
